Privacy, terms and safety

1. Who provides the service

Verdlo (the getverdlo.com website and the iPhone and Android apps) is run by Axperts Dariusz Zalewski, ul. Pelikana 1/3, 71-698 Szczecin, Poland, tax ID (NIP) 851-319-21-09, REGON 363785540 ("we"). Contact: biuro@axperts.pl.

2. What Verdlo does

1. Verdlo helps you plan a garden: you draw your plot or type its size, answer a few questions, and the studio shows garden ideas with a plan in metres, a plant list, a cost estimate, a watering plan and illustrative pictures.
2. The plan and the figures are worked out from what you enter. A picture is illustrative: it shows how the garden could look, not how it certainly will.
3. Verdlo does not replace a land survey, a building design, permits or the work of professionals (utilities, drainage, retaining walls, work near trees). Before you dig, check with your local authority or the utility operators where underground services run.
4. Cost estimates are indicative. Prices in shops and from contractors change, and whether a plant thrives depends on conditions and care we cannot see.

3. Using Verdlo

1. The studio works in the browser and in the apps without an account.
2. You need an account to keep a garden, draw more pictures and buy extras. You can create one with Google, Apple or a code sent to your email address.
3. You can delete your account at any time on the account page or in the app. Deleting it removes your gardens, pictures and sign-in data. Records of purchases are kept without personal data for as long as accounting law requires.
4. You may not use Verdlo in a way that harms others or the service, in particular to upload photos you have no right to, photos showing other people's property or people without their consent, or to order pictures automatically in bulk.

4. What is free and what is paid

1. Free: the whole studio, garden ideas, the plant list, the cost estimate, the watering plan, one kept garden and one picture. To protect the service from abuse, the number of free pictures is also limited per internet connection per day.
2. Paid: the "My garden project" pack, picture packs, and the subscriptions "The garden through the year" and "Pro for firms". The current description and price of each product are on the pricing page and on the purchase screen before you pay.
3. Prices are gross (VAT included). On the website we charge in Polish złoty; prices in other currencies are for information.
4. A pack is bought once. What it unlocks stays on your account for as long as Verdlo runs. Pictures from a pack are used up when drawn; a picture that could not be drawn does not use up the pack.
5. A subscription renews automatically for the next period (a month or a year) until you turn it off. Turning it off takes effect from the next period. Before a yearly subscription bought on the website renews we send a reminder to the account's email address. Subscriptions bought in the App Store or Google Play renew and send reminders under those stores' rules.

5. Payments

1. On the website you pay through Stripe: BLIK, Przelewy24 or card (subscriptions: card). We never see or store card details.
2. In the apps you pay through the App Store or Google Play under their rules; you also manage subscriptions and request refunds there. How to withdraw from the contract is in point 6.
3. A subscription bought on the website is managed in the Stripe customer portal, linked from the account page.
4. We issue a VAT invoice on request to biuro@axperts.pl; if you buy as a business, give your tax ID at purchase or at the latest in that message.

6. Withdrawal

1. A consumer may withdraw from a distance contract within 14 days without giving a reason, by writing to biuro@axperts.pl.
2. Packs and pictures are digital content delivered right after payment. Before purchase we ask for your consent to delivery before the 14 days have passed and for your acknowledgement that you lose the right of withdrawal once it is delivered (Article 16(m) of Directive 2011/83/EU; Article 38(1)(13) of the Polish Consumer Rights Act). If you do not give this consent, we deliver the content after 14 days.
3. A subscription is a digital service. You may withdraw within 14 days of purchase. For a subscription bought on the website or in Google Play we refund the full payment; for a purchase in Google Play you can also ask Google Play for a refund directly within the first 48 hours. A subscription bought in the App Store is refunded by Apple: you ask Apple for the refund, at reportaproblem.apple.com.
4. We make the refund within 14 days of receiving your statement, with the same payment method: for a purchase on the website through Stripe, for a purchase in Google Play through Google Play.

7. Complaints

1. If something does not work as promised, write to biuro@axperts.pl: what happened, when and on which account. We reply within 14 days.
2. Consumers have the rights set out for digital content and services that do not conform to the contract: bringing them into conformity, a price reduction or termination.
3. Consumers in Poland may also contact their municipal or district consumer ombudsman or the Trade Inspection.

8. Your photos and gardens

1. A garden photo sent to draw a picture is processed once, stripped of metadata (including GPS location) and not stored. We only keep the picture that results.
2. Your gardens, photos and pictures are yours. We use them only to provide the service to you. We do not use them to train models, in advertising or as examples without your explicit, recorded consent.
3. When you share a link to a garden, anyone who has it can see that garden's plan and pictures until the link is turned off.

9. Liability

1. We take care that plans, plant lists and figures are correct. The plants in the catalogue were checked for Polish conditions by a gardener with thirty years of practice.
2. We are not liable for the consequences of decisions taken solely on the basis of an illustrative picture or an estimate, without checking dimensions, site conditions and local rules. For consumers, this limitation does not exclude liability that mandatory law provides.

10. Changes and final provisions

1. We may change these terms for an important reason (a change in law, new features, security). We will announce a change on the website and by email at least 14 days in advance. A change does not affect purchases already made.
2. Polish law applies to matters not covered here. A consumer keeps the protection given by the law of the country where they live.

1. Controller

2. What data, why and on what basis

Garden letters (frost warnings, Monday's watering, the jobs at the start of the month) go to your account's email address while you have "The garden through the year" or "Pro for firms". You stop them through the link at the bottom of each letter and the button on the page it opens, or with the switch for letters on the account screen in the app. You turn reminders on the phone off in the app, and we then delete the phone's token, or in the phone's settings.

We send Google Analytics no account number, email address, name or garden content. Without consent to advert measurement, all our statistics keep of a visit from an advert is that it came from a Google advert, without the click identifier.

App versions older than 2.1.0 do not ask for consent: they make the random install number on first launch and send it to us with the events, not linked to the account. We count such events on the basis of legitimate interest (Art. 6(1)(f)) until the app is updated. You can object by writing to us, or update the app. The new version asks for consent and never sends us the number from the old one: it deletes it when it starts without consent to statistics and at your first answer to the question, and after a yes it makes a new number.

We do not ask for your phone's location and we do not profile you in a way that has legal effects.

3. Who receives data

Those without whom the service does not work, and Google if you agree to it.

Companies that process data on our behalf (data processing agreements):

• OpenAI (drawing pictures and, for a photo, sending the photo once without metadata; USA, standard contractual clauses and the EU-US Data Privacy Framework),
• Resend (sending sign-in codes and garden letters; USA, as above),
• Cloudflare (website delivery network and attack protection),
• Stripe (website payments; Stripe collects payment details, not us),
• Apple (Apple Push Notification service) and Google (Firebase Cloud Messaging): when you turn on reminders in the app, they deliver the notification to your phone. They receive the phone's token and the notification's text (for example the names of the plants a frost threatens) only to deliver it. On Android, so that a notification can arrive, Firebase sets up an installation id on the phone, also without consent to statistics; it serves only to deliver notifications; USA, EU-US Data Privacy Framework,
• Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland): Google Analytics on the website and Google Analytics for Firebase in the apps, only with your consent to statistics. Google may also process this data in the USA (Google LLC, EU-US Data Privacy Framework; the agreement also contains standard contractual clauses).

Each of these companies must protect the data at least as well as this policy describes.

Separate controllers, who decide about the data under their own rules:

• Apple and Google (sign-in with their accounts and payments in their stores),
• the Polish Head Office of Geodesy and Cartography (ULDK service): when you enter a parcel number we ask for its outline and send only that number,
• Google Ireland Limited as Google Ads, only with your consent to advert measurement, on the website and in the Android app (the iPhone app does not measure adverts): what followed a click on a Google advert: ideas, a picture, a saved garden (also a new account or a sign-in) or a purchase, with the amount, and the click or install identifier; no name and no email address. Without that consent Google Ads gets nothing from us. How Google uses data from partner sites and apps: https://policies.google.com/technologies/partner-sites?hl=en

We show no adverts in Verdlo, build no advertising audiences and sell no data.

Verdlo's servers are in Poland. The weather forecast is worked out on our own server from open weather data, so the region you choose is not sent to anyone.

4. Your rights

You may request access to your data, its correction, deletion, restriction and portability, object to processing based on legitimate interest, and withdraw consent at any time. Downloading all your data and deleting your account are available immediately on the account page. You may lodge a complaint with the Polish supervisory authority, the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw), or with the authority in the country where you live.

You can withdraw consent to statistics and to advert measurement at any time: on the website through "Privacy settings" in the footer, in the app under Privacy, on the sign-in or account screen. It works at once: we stop sending data, and the website and the app delete their numbers (Google's cookies in the browser, the install number and the Google Analytics identifier in the app). What was collected before goes after the periods in the table. Without consent Verdlo works the same, including what you bought.

5. Cookies, browser storage and identifiers in the app

• Session cookie verdlo: keeps you signed in; strictly necessary, no consent needed.
• Browser storage for your garden draft (autosave), the theme setting and your answer in the banner: needed for the service to work, never leaves your device.
• Random tab number for counting studio steps: only with consent to statistics; without consent events are counted without a number.
• _ga and _ga_<number> (Google Analytics): tell browsers and visits apart; only with consent to statistics; up to 2 years, browsers often shorten this.
• _gcl_au and _gcl_aw (Google Ads), when Google sets them: link a click on an advert with what followed it (point 2); only with consent to advert measurement; up to 90 days.
• In the app: Verdlo's random install number and the Google Analytics for Firebase install identifier, kept in the app's folder, only with consent to statistics (versions older than 2.1.0 keep the install number without asking, point 2); gone when you withdraw consent or delete the app.
• The app does not read the phone's advertising identifier (IDFA on the iPhone, the Google advertising ID on Android).

Until you agree, the website does not connect to Google Analytics or Google Ads and sets no Google cookies. On the page of a shared garden Google Analytics does not run at all, because its address opens the garden.
